1.3 “Services” include performance enhancement services, online appointments, community engagement, and educational resources provided through the Platform.

1.4 “Content” refers to all information, text, graphics, videos, and other materials available on the Platform.

2. Eligibility

2.1 Users must be at least 18 years of age or the age of majority in their jurisdiction to use the Platform.

2.2 By accessing the Platform, you represent and warrant that you meet the eligibility criteria and have the authority to agree to these Terms.

3. User Accounts

3.1 Account Registration: Users may be required to create an account to access certain features. Registration requires providing accurate and complete information.

3.2 Account Responsibility: Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their account.

3.3 Unauthorized Access: Users must notify MySportsPsych immediately of any unauthorized use of their account.

4. Services Provided

4.1 MySportsPsych facilitates performance enhancement services, including:

  • Booking appointments with certified professionals.
  • Accessing courses on mental training and sports psychology.
  • Engaging with a community of trainers and athletes.

4.2 The Platform does not provide mental health or medical services. Users are advised to consult licensed professionals for mental health concerns.

5. Payments and Fees

5.1 Pricing: Fees for services, including appointments and courses, are displayed on the Platform.

5.2 Payment Process: Payments must be made through the secure payment methods provided on the Platform.

5.3 Refund Policy: Refunds are subject to the policies outlined on the Platform. Users must review these policies before making payments.

6. User Responsibilities

6.1 Users agree to:

  • Provide accurate information during registration.
  • Use the Platform for lawful purposes only.
  • Refrain from posting harmful, abusive, or infringing content.

6.2 Prohibited activities include:

8.2 Platform Content: All Platform content is owned by MySportsPsych and is protected by intellectual property laws.

9. Privacy

9.1 MySportsPsych’s Privacy Policy governs how we collect, use, and protect user data. Users must review this policy to understand their rights.

10. Disclaimers and Limitations of Liability

10.1 The Platform is provided “as is” without warranties of any kind.

10.2 MySportsPsych is not liable for:

  • Errors, delays, or interruptions in service.
  • Losses resulting from user reliance on information provided.

10.3 Users use the Platform at their own risk.

11. Indemnification

11.1 Users agree to indemnify and hold MySportsPsych harmless from any claims arising from their use of the Platform.

12. Termination

12.1 MySportsPsych reserves the right to suspend or terminate accounts for violations of these Terms.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by the laws of India.

13.2 Disputes must first be resolved through negotiation. If unresolved, disputes will be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Refund and Cancellation Policy

MySportsPsych (“we,” “our,” or “us”) is committed to ensuring a transparent and fair process for refunds and cancellations. This Refund and Cancellation Policy (“Policy”) outlines the terms and conditions for requesting and processing refunds and cancellations for services provided through our Platform. By using our Platform, you agree to this Policy.

1. Scope

This Policy applies to all services offered on the MySportsPsych Platform, including but not limited to:

  • Appointments with sports psychologists and trainers.
  • Courses and educational programs.
  • Membership subscriptions.

2. General Refund Policy

2.1 Refund Eligibility

Refunds may be granted under the following conditions:

  • The service was not delivered as promised due to technical or administrative errors.
  • The user cancels a booking within the allowed cancellation window.
  • The course or service was canceled by MySportsPsych or the professional providing the service.

2.2 Non-Refundable Items

Certain items or fees may not be eligible for a refund, including but not limited to:

  • Partially used services.
  • Services completed as per agreement.
  • Processing fees associated with payment methods.

3. Cancellation Policy

3.1 Appointments

  • Users may cancel or reschedule appointments through the Platform.
  • Cancellations made at least 24 hours before the appointment time will be eligible for a full refund.
  • Cancellations made less than 24 hours before the appointment time may incur a cancellation fee.

3.2 Courses

  • Users may cancel course registrations within 7 days of purchase for a full refund, provided the course has not been accessed.
  • No refunds will be issued for courses that have been accessed or completed.

3.3 Memberships

  • Monthly subscriptions may be canceled at any time, and no further charges will be applied after the current billing cycle.
  • Annual subscriptions may be canceled within 14 days of purchase for a full refund, provided no services have been used.

4. Refund Process

4.1 Request Submission

  • Users must submit refund requests via email at support@mysportspsych.com or through the Platform’s support section.
  • Include relevant details such as transaction ID, booking or order reference, and the reason for the request.

4.2 Processing Time

  • Refund requests will be reviewed and processed within 7-10 business days.
  • Approved refunds will be issued via the original payment method.

4.3 Refund Denial

  • Refunds may be denied if the request does not comply with this Policy or if there is evidence of misuse or fraudulent activity.

5. Disputes

If you disagree with the outcome of a refund or cancellation request, you may escalate the matter to support@mysportspsych.com. Disputes will be reviewed in accordance with our Terms and Conditions.

6. Changes to This Policy

MySportsPsych reserves the right to modify or update this Policy at any time. Significant changes will be communicated through the Platform or via email.

Service Agreement for Trainers

This Service Agreement (“Agreement”) is entered into between MySportsPsych (“Company,” “we,” “our,” or “us”) and the individual or entity providing services on the Platform (“Trainer,” “you,” or “your”). By signing this Agreement or using our Platform, you agree to the terms outlined below.

1. Scope of Services

1.1 The Trainer agrees to provide professional services, including but not limited to sports psychology, mental training, performance coaching, or related services, as described on the MySportsPsych Platform.

1.2 The Trainer will deliver services in a professional and ethical manner, adhering to applicable laws, regulations, and industry standards.

2. Eligibility and Representations

2.1 The Trainer represents and warrants that they:

  • Are at least 18 years old.
  • Hold all necessary certifications, qualifications, and licenses to provide the stated services.
  • Comply with all applicable legal and professional requirements.

2.2 The Trainer agrees to maintain the accuracy of their profile information on the Platform, including qualifications, certifications, and availability.

3. Independent Contractor Status

3.1 The Trainer is engaged as an independent contractor and not an employee, partner, or agent of the Company.

3.2 This Agreement does not create an employer-employee relationship. The Trainer is solely responsible for:

  • Payment of taxes and contributions.
  • Obtaining and maintaining liability insurance if required.
  • Managing their schedule and service delivery.

4. Compensation

4.1 The Company will remit payments for services rendered based on the rates agreed upon and displayed on the Platform.

4.2 Payment terms:

  • Payouts will be processed within 7-10 business days after the successful completion of services.
  • The Company may deduct applicable fees or charges as outlined in the Trainer’s account agreement.

4.3 Trainers are responsible for tracking their earnings and reporting income as required by law.

5. Use of the Platform

5.1 Trainers must:

  • Use the Platform for authorized purposes only.
  • Not engage in activities that harm the integrity or reputation of the Company.

5.2 Trainers are prohibited from:

  • Soliciting clients outside the Platform for services initially booked through MySportsPsych.
  • Sharing or misusing confidential information of the Company or clients.

6. Confidentiality

6.1 Trainers agree to protect and maintain the confidentiality of all sensitive information, including but not limited to:

  • Client details and communications.
  • Proprietary information related to the Company’s operations.

6.2 The confidentiality obligation survives the termination of this Agreement.

7. Code of Conduct

7.1 Trainers are expected to:

  • Provide services with professionalism and integrity.
  • Communicate respectfully with clients and the Company’s staff.
  • Adhere to the ethical guidelines of their profession.

7.2 Any violation of the Code of Conduct may result in immediate termination of this Agreement.

8. Termination

8.1 This Agreement may be terminated:

  • By either party with 30 days’ written notice.
  • Immediately by the Company in cases of breach of this Agreement, misconduct, or violation of applicable laws.

8.2 Upon termination, the Trainer must cease using the Platform and return or delete any confidential information obtained during their engagement.

9. Dispute Resolution

9.1 Any disputes arising under this Agreement will first be resolved through good faith negotiations.

9.2 If negotiations fail, disputes will be settled through arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the arbitration venue in India.

10. Indemnification

The Trainer agrees to indemnify and hold harmless the Company from any claims, damages, or losses resulting from:

  • Breach of this Agreement.
  • Misconduct or negligence in delivering services.
  • Violations of applicable laws or professional standards.

11. Amendments

The Company reserves the right to update or modify this Agreement. Trainers will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised terms.

12. Governing Law

This Agreement is governed by the laws of India. Any disputes not resolved through arbitration will be subject to the jurisdiction of the courts in India.

13. Miscellaneous

13.1 Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements.

13.2 Severability: If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Assignment: The Trainer may not assign this Agreement without the prior written consent of the Company.

14. Acknowledgment

By signing below or accepting electronically, the Trainer acknowledges that they have read, understood, and agreed to the terms of this Agreement.

Code of Conduct for Users and Trainers

At MySportsPsych, we strive to maintain a professional, respectful, and inclusive environment for all participants. This Code of Conduct outlines the expectations for both Users and Trainers when using our Platform. By accessing or providing services through the Platform, you agree to comply with these guidelines.

1. General Principles

1.1 Treat all individuals with respect, dignity, and professionalism.

1.2 Foster a supportive and inclusive community that values diversity.

1.3 Act in good faith and in the best interest of others when engaging on the Platform.

1.4 Refrain from any behavior that undermines the integrity, safety, or trust of the community.

2. Code of Conduct for Users

2.1 Professional Interactions

  • Communicate respectfully with Trainers and other users.
  • Provide accurate and honest information during bookings, assessments, or interactions.

2.2 Appropriate Usage

  • Use the Platform and its services only for their intended purposes.
  • Do not misuse or exploit any features for illegal, harmful, or unauthorized purposes.

2.3 Confidentiality

  • Respect the privacy and confidentiality of Trainers and other users.
  • Do not share sensitive information obtained during sessions without explicit consent.

2.4 Prohibited Activities

  • Avoid abusive, discriminatory, or offensive language or behavior.
  • Do not harass, intimidate, or threaten Trainers or other users.

3. Code of Conduct for Trainers

3.1 Professionalism

  • Deliver services ethically and responsibly, adhering to relevant industry standards.
  • Respond promptly to user inquiries and maintain clear communication.

3.2 Accuracy and Transparency

  • Ensure your profile information, qualifications, and certifications are accurate and up to date.
  • Clearly communicate session details, fees, and expectations to users.

3.3 Confidentiality

  • Safeguard the privacy and sensitive information of users.
  • Do not disclose user information without proper authorization, except as required by law.

3.4 Prohibited Conduct

  • Avoid any form of discrimination, harassment, or unprofessional behavior.
  • Do not solicit or accept payments outside the Platform for services offered through it.
  • Refrain from engaging in conflicts of interest or exploiting users for personal gain.

4. Consequences of Violations

4.1 MySportsPsych reserves the right to take appropriate actions against violations of this Code, including but not limited to:

  • Issuing warnings or suspensions.
  • Terminating accounts.
  • Reporting unlawful behavior to authorities.

4.2 Decisions regarding violations are at the sole discretion of MySportsPsych and are final.

5.1 Users and Trainers are encouraged to report any violations of this Code or inappropriate behavior by contacting support@mysportspsych.com.

5.2 Reports will be handled confidentially and investigated promptly.

6. Acknowledgment

By using the Platform, Users and Trainers acknowledge and agree to abide by this Code of Conduct. Failure to comply may result in the suspension or termination of access to the Platform.
